This bill defines "adult performance" as any obscene or performance harmful to minors, including acts like topless dancing, stripping, or simulated sexual activities, and clarifies that "performance harmful to minors" is content that appeals to prurient interest in minors, depicts sexual content in a way that is patently offensive to minors, and lacks serious artistic or educational value for them. It prohibits anyone from performing or exhibiting an adult performance in public or where minors could see it, and also prevents state agencies and local governments from funding or showing such performances with public money. Furthermore, the bill creates a legal avenue for individuals, including parents of minors, to sue those who organize, host, or fund these performances in violation of the law, allowing them to seek injunctions, damages, and legal costs, and explicitly states that sovereign immunity will not be a defense in such cases, while also preempting local ordinances that conflict with these new statewide rules, though it ensures these provisions do not violate free speech rights.
